Welcome to Forcesign.com. This Web site is provided by Force Sign (referred to throughout this Web site as Force Sign) as a service to our customers. Please review the following basic rules that govern your use of the Force Sign. Please note that your use of the Forcesign.com site (the "Site") constitutes your unconditional agreement to follow and be bound by these Terms and Conditions. Although you may "bookmark" a particular portion of this Site and thereby bypass this Agreement, your use of this Site still binds you to these Terms and Conditions. Force Sign reserves the right to update or modify these Terms and Conditions at any time without prior notice to you. Your use of the Site following any such change constitutes your unconditional agreement to follow and be bound by these Terms and Conditions as changed. For this reason, we encourage you to review these Terms and Conditions whenever you use this Site.

Terms of Sale
All Sales are final. We do not accept returns on any of our products. It is up to you to provide us with the correct file for printing. All products before leaving our shop are inspected and compared with the file you provided us.

Preparatory Materials
All files provided electronically will be returned to you upon completion of the printing project. We do not retain any files on behalf of our customers. Please be sure to keep files and job number in a safe place if you expect to reprint the job in the future. 'CLIENT' is solely responsible for maintaining files-please request and keep copies of any file we produce for you!

Delays or Missed Deadlines
Force Sign is not responsible for delays caused by fire, water, strikes, theft, vandalism, war, riot, civil disorder, accidents, action of government or civil authority, acts of God and other causes beyond our control. We also assume no responsibility for delays caused by delivery carriers or any damages resulting from the failure to receive a job on time. Our expected delivery date is not guaranteed, although we rarely miss a due date. An order may arrive late due to unforeseen delays in delivery service, the breakdown of equipment, strikes, illnesses, etc.

Delivery
Delivery for Banners is Free for all orders over Five Hundred American Dollars. All Orders Seventy Five American Dollars to four hundred ninety nine American Dollars are subject to a Fifty American Dollar delivery Charge. To be included in the final price presented to the customer through our website. Delivery for corrugated plastic signs is free for all orders over five hundred US dollars. For orders of $75 US Dollars to $499 US dollars the delivery charge is $75 US dollars.

Customer Responsibilities
Customers are 100% responsible for the accuracy of your layouts and are encouraged to proof each job carefully. Customers are also 100% responsible for compliance with postal regulations and current mailing restrictions association with postcards and mailers.

Electronic Manuscript or Image
It is the customer's responsibility to maintain a copy of the original file. Force Sign is not responsible for accidental damage to media supplied by the customer or for the accuracy of furnished final output. Until digital input can be evaluated by Force sign, no claims or promises about our ability to work with jobs submitted in digital format, and no liability is applicable to problems that may arise.

Alterations/Corrections
If corrections are needed, we will contact you immediately and give you the option of making the changes and sending us new files or cancel the sale.

Color Variations from the Proof
Because of differences in equipment, paper, inks and other conditions between color proofing and production pressroom operations, a reasonable variation in color between color proofs and the completed job is expected. When variations of his kind occur, it will be considered acceptable performance. Force Sign prints every project in keeping with standards for the printing industry. Force Sign makes no guarantee that the color you see on your computer monitor or your color printer will approximate your finished piece printed via the CMYK process. Wide variation in color spaces, technologies and calibrations of different monitors and printers may preclude an exact match.

Sales Tax
All North Carolina Residents are subject to sales tax.

Mailing Lists
Customer's mailing list(s) will not be sold or offered for use to any other party while in the possession of Force Sign. All Mailing List(s) is the exclusive property of the customer and shall be used only with customer's instructions. Force Sign will not utilize the customer’s list for any other purpose.

Shipping & Postal Delivery Times
All delivery dates are estimate. Force Sign has no control over the, United Parcel Service, Federal Express (FEDEX) or any other common carriers' delivery schedules and cannot guarantee when mail or shipments deposited with or released to these carriers will be delivered.

Errors in Mailing
Force Sign shall be liable only to the extent of re-mailing a correction or corrected job as soon as possible to rectify the mistake. Damages shall be limited to the value of the work performed. In no case is Force Sign liable for loss of business; incidental or consequential damages; or costs in excess of billing for services related to the specific job.

The customer will defend and hold Force Sign harmless in any suit or court action brought against Force Sign by others for alleged damages, costs, expenses (including reasonable attorney's fees), liabilities or losses resulting from circumstances where Force Sign acting as the customer's agent, uses copy, photographs, or illustrations that are believed by others to be degrading, libelous or harmful to their reputations, images, or standing in the community or which in Force Sign sole judgment is an infringement on a trademark, or trade name, or service mark, or copyright belonging to others, or in a suit or court action brought against Force Sign for actions of the customer's employees which may occur as a result of any mailing.

Indemnity
Customers agree to indemnify and hold Force Sign, its subsidiaries, affiliates, officers, agents, co-branders, vendors, partners, employees or assigns harmless from any claim or demand, including reasonable attorney's fees, made by a third party due to or arising out of content submitted, posted or transmitted through Force Sign, customer violation of the terms and conditions detailed here, or customer violation of the rights of a third party.

Copyright Infringement
The customer warrants that the subject matter to be reprinted is not copyrighted by a third party. Customers also recognize that because subject matter does not have to bear a copyright notice in order to be protected by copyright law, absence of such notice does not necessarily assure a right to reproduce. Customers further warrant that no copyright notice has been removed from any material used in preparing the subject matter for reproduction. To support these warranties, customers agree to indemnify and hold Force Sign harmless for all liability, damages and attorney's fees that may be incurred if any legal action connected with copyright infringement involving the work produced or provided.

Customers also warrant that the work does not contain anything that is libelous or scandalous, or anything that threatens anyone's right to privacy or their personal or economic rights. Customers will, at their sole expense, promptly and thoroughly defend Force Sign in all legal actions on these grounds as long as Force Sign notifies customers of legal action and gives the customer reasonable time to undertake and conduct defense. Force Sign reserves the right to use its discretion in refusing to print anything that it deems illegal, libelous, scandalous, improper or infringing upon copyright law. Your use of this site, your placement of an order Force Sign indicates your acceptance of these terms and conditions. These terms and conditions shall supersede any subsequent terms or conditions included with any purchase order, whether or not such terms or conditions are signed by Force Sign. Force Sign reserves the right to make changes to this site and these terms and conditions at any time.

Force Sign provides this Website as a service to its clients (including its employees and agents) and assumes no responsibility for consequences resulting from the use of information herein, (or from the use of the information obtained to linked addresses) or in any respect for the content within this site.

Force Sign is not responsible for, and expressly disclaims all liability for, damages of any kind arising out of use, reference to, or reliance on any information contained with the site. While the information contained herein is periodically updated, additional facts and information or future developments may affect the subjects addressed and no guarantee is given that the information provided in this Website is correct, complete, and up-to-date.

Jurisdiction and Venue
You agree that any legal action brought against Force Sign shall be governed by the laws of the state of North Carolina without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or with Force Sign shall be an appropriate federal or state court located in North Carolina.

Rights to Promotion
Force Sign reserves the right to use any items produced, either printing, or graphic design file for displays, catalogs, flyers, website, or advertisement and other promotional uses, unless indicated on purchase order Invoice or in writing.
